These Terms & Conditions ("Terms") govern your access to and use of Cash4Homes.us, sell.cash4homes.us, and any related pages, forms, content, communications, or services that link to these Terms (collectively, the "Site"). By accessing or using the Site, submitting information, or contacting Cash4Homes through the Site, you agree to these Terms. If you do not agree, do not use the Site.

Purpose of the Site

Cash4Homes provides information about a possible direct purchase of residential and other qualifying real property. The Site is intended to help property owners request information, a property review, or a possible cash offer. Cash4Homes is a direct buyer and is not acting as your real estate agent, broker, attorney, financial advisor, tax advisor, lender, title insurer, or fiduciary unless a separate written agreement expressly says otherwise.

No Offer, Contract, or Obligation

Information on the Site is for general informational purposes only. A form submission, phone call, text message, property review, preliminary conversation, estimate, or verbal discussion is not a binding offer, contract, commitment to purchase, or promise of a particular price or closing date.

Any purchase of real property by Cash4Homes is subject to our review and approval, due diligence, property condition, ownership verification, title review, financing or funding availability where applicable, completed documentation, required signatures, and a fully executed written agreement. No real-estate purchase agreement is binding unless it is in writing and signed by the parties required to sign it.

You are not required to accept any offer from Cash4Homes. You may seek independent advice from a licensed real-estate professional, attorney, tax advisor, financial advisor, or other qualified professional before making a decision about your property.

Eligibility and Accurate Information

You represent that information you submit is accurate, current, and complete to the best of your knowledge. You agree to promptly update information if it materially changes.

If you submit information about a property, you represent that you are the owner, a person authorized to act for the owner, or otherwise authorized to provide the information and request contact regarding the property. You agree not to submit information that is false, misleading, unlawful, defamatory, infringing, or harmful.

Communications Consent

By providing contact information, you agree that Cash4Homes may contact you regarding your inquiry by phone, text message, email, or other method, subject to applicable law and your communication preferences. Marketing texts may require separate consent where required by law. Consent is not a condition of receiving an offer or completing a transaction. Message and data rates may apply. Intellectual Property

The Site and its text, design, graphics, logos, videos, photographs, software, and other content are owned by or licensed to Cash4Homes and are protected by applicable intellectual-property laws. To the fullest extent permitted by law, Cash4Homes disclaims warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and security.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any information on the Site is complete, current, or accurate in every circumstance.

Limitation of Liability

To the fullest extent permitted by law, Cash4Homes and its owners, officers, employees, agents, contractors, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or business interruption arising from or related to your use of, or inability to use, the Site.

To the fullest extent permitted by law, Cash4Homes' total liability for any claim arising out of or relating to the Site or these Terms will not exceed the greater of (a) the amount you paid, if any, to use the Site during the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain warranty exclusions or limitations of liability. In those jurisdictions, the above limitations apply only to the extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Cash4Homes and its owners, officers, employees, agents, contractors, affiliates, and service providers from claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of the Site, or your violation of another person's rights.

Governing Law and Venue

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles. Subject to applicable law, any dispute arising out of or relating to these Terms or the Site must be brought exclusively in the state or federal courts located in Montgomery County, Alabama, and you consent to the jurisdiction and venue of those courts.

Changes to These Terms

We may modify these Terms from time to time. We will post the updated Terms on the Site and revise the Effective Date above. Your continued use of the Site after updated Terms are posted means you accept the updated Terms.
